This page contains the legal terms and conditions governing the website www.workingsafeshop.pt. Browsing the website implies acceptance of all provisions contained herein. All purchases of products made through the website are governed by these general conditions and other terms of use contained on the site. All customers are invited to read these general conditions carefully.

Working Safe reserves the right to modify the content of the website (prices and photos, for example) at any time, without prior notice and at its own discretion. Any modification made will take effect on the date of its publication.

These general conditions of sale regulate the commercial relations between:

JP SUPER SOLES, Lda., and its online customers (hereinafter referred to as 'The Customer').

Prior to any transaction, the Customer confirms having read and expressly declares to accept these general conditions by pressing the 'I accept' button.

 

1. Special conditions of sale

The Customer confirms having read, at the time of placing the order, the special conditions of sale stated on the screen (denomination, price, components, weight, quantity, colour, product specifications, service cost, etc.) and expressly declares to accept them without reservation. The placement of the order and its confirmation by the Customer embody their full and total acceptance of the special conditions of sale, applicable exclusively to the order in question.

The special conditions of sale complement these general conditions and prevail over them in anything not regulated therein.

 

2. Order

The Customer confirms the order by pressing 'Add to basket'. The order consists of a summary of all items that the Customer confirms by clicking the 'I accept the T&Cs and pay' button in the menu bar.

The automatic registration systems of JP SUPER SOLES, Lda., are considered as proof of the nature, content and date of the order.

These general conditions of sale in paper form must be attached and duly signed by the Customer.

 

3. Order confirmation

JP SUPER SOLES, Lda., confirms the acceptance of your order to the Customer by one of the following means of their choice: email or post. The order will only be completed after the Customer receives confirmation from JP SUPER SOLES, Lda.

JP SUPER SOLES, Lda., reserves the right not to confirm an order, for whatever reason, considering in particular the supply of products, problems concerning the order received (e.g. an illegible document), abnormal orders or a foreseeable reason relating to future delivery. If an order cannot be confirmed, JP SUPER SOLES, Lda., will notify the Customer by all means at its disposal.

All new orders will only be considered valid after payment by the Customer of any amounts owed to JP SUPER SOLES, Lda., referring to any previous orders.

The delivery of any order will only be made after settlement by the Customer of all amounts owed to JP SUPER SOLES, Lda.

 

4. Order delivery and supply conditions

The place and date of order delivery are chosen by the Customer at the time of placing the order. JP SUPER SOLES, Lda., reserves the right to use any carrier of its convenience to deliver the products to the address indicated by the Customer. Deliveries are only made in Portugal.

 

5. Delivery time

Deliveries are made within 1 to 14 working days after payment, depending on item availability and service provided. If one of the items is out of stock when the order is placed, the Customer will be promptly notified, with JP SUPER SOLES, Lda., confirming the next available date or proposing an equivalent replacement item. In this case, the Customer has 3 days to indicate whether they want to replace the item or wait for stock replenishment. After this period, if there is no response from the Customer, JP SUPER SOLES, Lda., will proceed with the order without the missing product, which will be delivered after stock replenishment. Delivery is at the recipient's risk.

 

6. Shipping Costs and other supply conditions

The shipping cost for the order is €5.00 (taxes included) for mainland Portugal, €7.50 (taxes included) for the islands of the Madeira and Azores Archipelagos.

Upon receiving the order, the Customer must sign the delivery note presented by the carrier, on which they can make any comments they deem appropriate. By signing the Delivery Note, the Customer confirms having received the indicated number of packages. Any complaints about damaged or missing products must be submitted to Customer Support Service, by email to cs@workingsafeshop.com, or by phone to +351 939 510 056 within a maximum of three days after receipt of the Order (date on the Delivery Note).

The occurrence of any force majeure event, for example, accident, strike, administrative decision or transport stoppage, that may delay, prevent or make the execution of the supply exorbitant, constitutes, by express agreement, a clause for suspension or extinction of the obligations of the company JP SUPER SOLES, LDA., without the right to compensation for the Customer if the occurrence in question extends beyond 15 days after the foreseen delivery period for the Order. In this situation, the Customer will be fully and automatically released from their contractual duties under this order.

The company JP SUPER SOLES, LDA., will notify the Customer by any appropriate means and on the day of the occurrence, in order to allow them to freely release themselves from the order(s) only by a simple response by mail or email after the notification received.

 

7. Shipping Partner

Deliveries will be made by a carrier chosen by Working Safe, during normal business hours. Please select the shipping address so that someone can receive the products.

 

8. Price

All prices indicated are in Euros and include VAT at the corresponding and legally applicable rate. The price invoiced to the Customer is the price indicated in the order confirmation sent by JP SUPER SOLES, LDA. Payment for the products and services will be made through the payment methods available on the website, in a secure environment on our service provider's server.

 

9. Product sheets

The photographs illustrating the products are merely indicative. The accompanying texts are a reproduction of the information contained in the technical sheets or their respective instructions for use. Any differences between the photographs and the products are minor and do not imply any alteration in the main specifications of the products. The colour of the products displayed in the online store may differ from the actual colour of the product.

 

10. Payment conditions

The ordered product(s) will be supplied in exchange for their respective payment by credit card, PayPal, MB Way or ATM payment.

 

11. Warranty

The customer will benefit from the legal warranty against undetectable defects or anomalies in the products sold. All our products are designed and manufactured with strict quality. However, this warranty does not cover any defects or anomalies resulting from improper handling, lack of maintenance or care that are contrary to our instructions for use. The Customer must consult the instructions and recommendations found in the instructions for use provided on the online site.

 

12. Exercise of the Right of Free Resolution

The customer has the right to withdraw from this contract within 14 calendar days, without needing to state any reason.

The withdrawal period expires 14 days after the day on which the customer or a third party indicated by them, who is not the carrier, acquires physical possession of the goods.

The right of free resolution must be exercised unequivocally by letter to JP SUPER SOLES, LDA., Rua das Lavagueiras, Nº309, 4550-536 Pedorido,
Castelo de Paiva, Aveiro, Portugal, or by email to cs@workingsafeshop.com. You can use the withdrawal form, but this is not mandatory.

For the free resolution period to be respected, it is sufficient that your communication regarding the exercise of the right of free resolution is sent before the end of the resolution period.

 

13) Effects of contract termination

Once the return is received and examined, we will process your refund and a credit will automatically be applied, within 10 business days, to your credit card or original payment method. Please note that, depending on your credit card issuer, after processing the credit it may take an additional 2 to 10 business days for it to actually be deposited into your account. A return fee may be charged, which will be deducted from the total refund amount.

In case of termination of this contract under the right provided in the previous clause, you will be refunded, without undue delay and, in any case, no later than 14 days from the date on which we were informed of your decision to terminate the contract. The refund will be made by the same payment method used for the purchase, unless another payment method is agreed upon. The refund will only be made after receipt of the returned goods, or until proof of shipment of the same is presented, whichever occurs first.

Without undue delay and no later than 14 days from the day you informed us of the termination of the contract. The deadline is considered to be met if you return the goods before the end of the 14-day period.

The direct costs of returning the goods (shipping costs) are the responsibility of the Customer.

The Customer will be liable for any loss of value of the goods, if this occurs due to handling that exceeds what is necessary to ascertain the nature, characteristics and functioning of the goods.
